muck_a_luckI send client the usual documents, wills, living wills (also called advance medical directives), and durable powers of attorney. 6 total, as each spouse gets their own of everything.
Dumb question:
1. Client: Do we need all the attached documents, other than the will itself? CL: OK, people. You decide what you want. Do you WANT a power of attorney? Do you WANT a medical directive?
Typical question:
2. Client: Do we have to have separate wills or can we have one? CK: Lots of people seem to think that a couple can share a single will between them. "Oh, we just want one will," is a typical first phone call thing to say. Nope. You can't share a will with another person. Gotta have two wills. They can be so-called mirror image wills, and spouses almost always leave their estates to each other as first beneficiaries, but you gotta have your own will.
Really, really dumb question:
3. Client: Do we need to fill in the blanks on the wills? CK: Nah, let's just leave it like that. It'll be cool! *shakes head*
